Another Suit Filed Over Fatal West Virginia Mine Fire

    Nobody forced these guys to work in a mine. They did it because it’s one of the best paying jobs for unskilled workers in W.Va. Working in a mine has been dangerous since the first mine was dug and will continue to be dangerous regardless of what safety measures are implemented. How much capital does the small number of miners think owners will invest in safety measures for them? There is an assumption of risk miners accept. It’s pollyannish to think that mines will ever be 100% safe. Pay the meds and the life insurance proceeds. Don’t unjustly enrich the families with big verdicts.

    Okay, this guy is suing for lung damage from the fire. This is lung damage that hasn’t happened yet but he just knows he’s going to have. He’s also managed to differentiate the damage to his lungs caused by the fire from the damage to his lungs from working in a coal mine. This guy’s doctors (read lawyers) are impressive, I wish I could get care like this.

    I’m not saying we shouldn’t hold mine owner’s responsible for maintaining adquequate protections to minimize the risk employees face, just that this sounds too much like another Dickie Scruggs telling people what they are “entitled” to and backing the Brinks truck to another hospital emergency ward.
