Can’t answer your question but this guy got treatment without any problem. People like his wife need to deal with the issue that he was an old man with a bad heart. Since his sorry butt was hauled into an ER he obviously already had the heart attack and any damage to his heart was already done. As mentioned previously, the drug they’re speaking of is used in stroke victims and must be administered within 2 hours to mitigate residual brain damage. What’ the old lady going to do with $10MM? at her age? It would have been better spent creating a fund to pay for legitimate claims and subsidize medical mal premiums.

Ray – you are so prejudiced and blind. What makes you think libs were on this jury and gave an award this large. You think the neo-cons wouldn’t vote this way? Maybe you’re too young, too stupid or have your blinders on. Wake-up FOOL, this is NOT a lib or neo-con thing.

Off my soap box, clearly we are missing information in this article and the verdict is disgusting. APPEAL, damnit, APPEAL.

LOL, I would venture to say that Ray was correct in his opinion. The jury was more inclined to side with the John Edwards types, someone must pay, so why not the doctor and his insurance company then “neo-cons” who deal a little more in reality.
Just read the comments of this article by the readers, a little more rational than the jury was!

None of you Quarterbacks were there to decide the issue of causation and damages. It’s a case where the Plaintiff’s attys did a hell of a better job than the Defense Firm’s attys hired by the Malpractice Ins Co. Let’s see, D’s billable hours plus scaring the pants off of claims managers plus chewing butts of the claims handlers, plus approval to go to court by the In Co’s A-VP’s, plus motions, interrogatories, answers, more motions, Research, soul-searching. Repeat all the foregoing by the Plaintiff’s attys. The winner says, “My lawyer can whoop up on your lawyer!”. All our kids should be brought up with Free Enterprise principles and backed up with a good solid education as Doctors, Lawyers, Judges, Ins Co’s execs. The ends justifying the means and the remains thrown to the bloggers on this IJ commentaries. Hah hah hah hah hah haha haha………and you lower class masses pound your chests and blame Liberals, Conservatives, and in-betweeners….ha ha ha ha ha hahhhhhhhhhhhhhh.

Let’s make the argument for professional juries…you likely wouldn’t see this sort of knee-jerk, sympathetic reaction from a group of professional jurors.

What a dumb statement – “for you unsuccesful insurance agents and brokers you wouldn’t be making the money”. That’s just a plain dumb statement. As an insurance agent we see the ramifications of irresponsible jury awards coupled with natures calamities, the impact it has on the insurance industry and the availability of insurance to the general public. Not too mention the availability of insurance products to sell to the public. When companies pull out because of unprofitability or close their doors due to excessive claims it impacts all of us. As insurance agents and brokers we struggle everyday to retain current clients and try to obtain new clients, but when we have companies pulling out it makes it difficult on all parties. Not too mention the agencies overhead so that we can pay employees, our rent, taxes and yes our own insurance.
Contrary to your thought process Buzz, we are not laughing all the way to the bank!

What people seem to forget, is that we are destined one day to DIE. No way out of it, is gonna happen. People want a way to make a quick buck, and since death won’t go away, someone is going to make a bundle out of it. One of these days, someone is going to realize that death is going to occur no matter what you do, and no matter what heroics are done, if it is your time to die, you are gonna die. Sorry folks, no way out of this one. Someone just figured a way to capitalize on it, and that is just not right.

Whether you like it or not, large claim payouts increase premiums over time, which increases income to agents. If you don’t like it, write business for no commission and don’t go to the bank.
