Despite some efforts by the state to clean up its clear Plaintiff\’s Bar control and favoritism, there are still counties in the state where there a literally no admitted defense attorneys and little representation on the bench by judges who have defense background. Forum shopping is still happening as well as courts are still reluctant to dismiss a case even where the parties are out-of-state and arguably WV law doesn\’t even apply.
