    It\’s the trial lawyers that want to see PIP end. Then they can sue anybody on any accident no matter what the injury or damage. The lawyers don\’t like PIP because it keeps them out of court. Just think…they can go for seven figure judgements over fender benders again, just because the PIP law sunsets. There will be law offices popping up all over with signs and billboards…it\’ll be beautiful. Welcome to Florida. Come on vacation leave on probation!

    Get real, Fla PIP has a verbal threshhold. It does not stop lawsuits. Just the opposite, it creates an additional funding source for the BI lawsuit. The only PI attorneys who want to see it go away are the ones who feel they would then have a better chance at getting their buddies in the legislature to mandate BI at a much increased limit.

    The hospitals don\’t want to see PIP end. They are more vocal than attorneys. Hospitals hold priority liens even over uninsured motorist settlements. I had a case with a brain-damaged 7 year old whose mother had $10,000 in UMBI coverage and the hospital refused to waive their lien despite knowing this child was going to need continuing care. I forced the case into Mediation, got a recommendation from the Mediator that they waive then went to court for a Minor\’s Court Settlement. The insurance carrier in that case spent about $7,000 fighting the hospital to give the mother of a brain-damaged child who had paid the premium for the coverage the policy benefit she deserved.

    Excellent. If you can say, I\’d like to know which company values justice and its policy holders that much; unless that was a rogue manager who was later repremanded for wasting company money.
    Agent: I guess you have never contended with PIP suits which outrageously enrich the lawyer with fees and multipliers.

    I will say it was Superior Insurance Company. Unfortunately, they are no longer in business. I was proud to be associated with that company and how we were permitted to conduct business on behalf of our customers. And yes, I have handled PIP matters as well as SIU. I know Florida issues very well…I\’ve even testified in the prosecution of some less than honorable people in both State and Federal Court.

    Until they do something about the 35% of all drivers in Fla that don\’t carry insurace. Right now the fine is cheaper then the rates for insurance. And if you put a downpayment and get a card, the fine is waived.

    What good is PIP or no PIP if the person that hit you doesn\’t have a license or insurance? They pay a $500 fine and you end up owing $$$$$$$ in medical.

    Florida drivers who do things legally can\’t afford to drop their personal injury – the odds are good that the guy that hits you won\’t have insurance.

    If they don\’t have insurance, many of them drive with very low limits anyway which would not take care of any serious injury.
    You have to carry enough insurance and of course fight your own carrier to get the UM when you need it..Florida is a utopia for the weather but sucks for everything else it seems

    Maybe our legeslators should look at a proposal in the Oklahoma legeslature that will require the officer to impound the vehicle and have it towed if at ANY traffic stop, you can not prove that you have it insured, you will have to pay to get it released, pay the tow bill & storage,and also present an insurance policy to get it released.
