    I wonder what the engineers determined from adjacent properties? If the next door neighbor is insured by a different company and that engineering firm determined surge to be the problem, wouldn\’t it be reasonable that adjacent properties should have a like determination? Scruggy doesn\’t seem to indicate that in any of his arguments. And why doesn\’t the entire Gulf Coast have a wind pool like Florida? Maybe his battle should be with the governmental bodies of all states with a coastline that don\’t have a windpool area and program to address it. Lord knows they\’ve had a reliable model in Florida for years and years. Maybe he\’ll sue his client\’s employer next. And that folks, would be you!

    As soon as Trent or anyone else can show the court or the insurance company what their property looked like between the time the wind damaged the house and the time the flood water swept it away, they will be paid pronto. I know not likely to happen, and they would not like the pay out anyway because there was a lot more damage from flood then from water, there is even satelite images showing water miles inland in Mississippi and Louisiana. The problem is that the customer has to prove there was wind damage before the flood and the insurance company only needs to show that there was flood damage. As soon as people accept that flood is not covered under a homeowners policy for ANY reason we can move on, it does not matter if it was \”wind driven\” or not, it is not covered, it does not matter if you think it should be covered, it is not. Wind is covered but you have to show what amount of damage was caused by wind before the flood, then you will be paid. Not easy to do and not likely to happen unless you had a video camera rolling during the storm. Remember the New Orleans did not have much wind damage, it was the day after the storm when the levies broken and everything flooded, look at the video of all the helicopters plucking people off the roofs, there was no shingle or roof damage to 99% of the homes, clearly not much wind damage but, but a total loss to flood, not covered under a homeowners policy. lawyers will be the only ones to get anything out of this goose chase.

    Yes, The Levee in New Orleans Broke After Katrina Winds.
    My Home in New Orleans was under water over 3 weeks BUT it can be fixed.
    It\’ is now being gutted and repaired.
    H O W E V E R ….
    My Home IN BAY ST.LOUIS (where the water came in & out in 24 hrs) IS BEYOND REPAIR. THE WIND BEAT THE DAYLIGHTS OUT OF IT AND STATE FARM BLAMED IT ALL ON THE WATER,
    SO SAY THEIR PRETEND ENGINEERING FIRM. THEY LIED ABOUT THE ENGINEERING FIRM AND I CAUGHT THEM.
    THE WIND CAUSED AT LEAST… HALF OF THE DAMAGE BUT THAT IS ALSO BLAMED ON THE WATER. WATER WASHED IT AWAY!
    Their Best Friend Mr. Water…
    and the Exclusion for WIND DRIVEN WATER….
    Is LIKE PEEING ON YOUR LEG
    AND SAYING IT\’S WATER.

    Insurance companies should keep all their papers for ever.
    The reason they are destroying the rain forests in Brazil is to build storage buildings to house all the records from the twentieth century.
    The reason NASA is going to Mars is for space to put the records of the 21st century.
