Insurer Groups: Ruling Suggests Flood Exclusion Valid, Enforceable

    Apparently State Farm is denying a lot of claims out there…. But that\’s State Farm\’s new game anyway these days.

    Either State Farm is heading for a Huge Class Action suit or everybody bitchn should sit down and shut up. Knowing the reputation of State Farm, I\’d bet we better start handing out the Chairs now, as well as the Muzzles, becouse, State Farm does not make it a policy to screw policyholders. You do not get to the top of this industry by dirty deeds. State Farm is the most highly thought of company in the industry today. They are the Gold Standard in Service, Dependability & Solvency. Their too smart to risk nonpayment of claims to spoil their reputation.

    Yes, the exclusions are in writing but this time it was Katrina Winds that hit land from 1 to 4 hours BEFORE THE WATER.
    WLOX Filming Katrina Live had the roof blown off their building in Biloxi. They have videos of Trees Being Blown Down by wind and rain and NO WATER PRESENT…you can see the green grass with the large trees blown down. The wind blew the roof off the Superdome in New Orleans and also hundreds of windows in high rise hotels and casinos.
    MY SUGGESTION TO AMERICA…
    ALLOW FEMA TO SELL
    HURRICANE INSURANCE.
    INCLUDING WIND AND WATER DAMAGE.
    THAT WILL RESOLVE WIND VS WATER FOREVER.
    The winds caused most of the damage first and the water washed it away.
    Shame on the Ins.Industry for their betrayal to their clients. Their punishment will be to loose the hurricane premiums and they can eat their extra 15% hurricane deductible too.

    Add Your 15% of your Insured Amount
    What\’s that total?
    Homeowners Rule: They only pay ABOVE THE WATER LINE…
    If you are lucky, they may agree to pay for a new roof.

    The Ins.Industry refuses to pay if your home vanished. So much for the \’above the water line rule\’ You won\’t even get paid for a shingle.     THIS IS THE BEST SOLUTION FOR THE PEOPLE.
    I WOULD RATHER PAY THE USA THAN A COMPANY LIKE STATE FARM INS THAT PAID AN ADJUSTER TO LIE TO ME IN SAYING THAT THE ENGINEERING FIRM SAID MY DAMAGE WAS ALL FROM WATER. WHEN I ASKED HIM FOR THE NAME OF THE ENGINEERING FIRM…HE REFUSED TO GIVE THAT INFO TO ME.
    LATER I LEARNED THAT AN ENGINEERING FIRM HAD NEVER EVEN BEEN AT MY HOME AND STATE FARM SAID THEY WERE SORRY. THEY WOULD SEND ANOTHER ADJUSTER OUT. ANOTHER LIE.
    ALL I GOT WAS ANOTHER PHONE CALL FROM A TRAINED STATE FARM REP TO DENY MY CLAIM AGAIN. STATE FARM REFUSED TO PAY $1.
    IS THERE ANY HONOR LEFT IN MEN?
    SHAME…SHAME…SHAME…
    YOU HAVE A CHOICE.

    The Dept of Ins makes Insurance Companies and their brokers sign an acceptance or rejection of UM coverage on both auto and Personal Umbrellas

    Why not require the insurance company providing the homeowner policy require the the insured to sign a form that says their broker has offered flood coverage
    and the insured has rejected it

    then when the storm happens this year
    the insured can not say he did not know of \”storm surge etc.\”

    Unfortunately for State Farm policy holders, they\’re learning what we on the independent agency side have known for years….they\’re only good for producing headaches and heartache. Now a MS policyholder is suing St. Farm because they ordered and used a second engineering report that supported flood damage rather than use the first report (from same engineering firm) that supported wind damage. I think this only the tip of the iceberg with misdealings by St. Farm.

    Hey Ind. Gal.
    I\’m independant and yes I compete with S.F. But everyone knows that most if not all HOMEOWNER\’s policy don\’t cover for flood, PERIOD. Even though every state is state specific. How many short years ago did Hurricane Camille hit. DID YALL FORGET. I didn\’t I lived in Mississippi and will never forget. Now I sell insurance in Florida. Oh by the way KIM DAVID, there\’s a bright idea to have the gov\’t provided Hurricane coverage. Let the gov\’t fix yea, right, like, the social security issue, immigration issue also???????? Why do people always look for the gov\’t when all they do to American\’s is screw us. I you want to see gov\’t work at it\’s finest come to Florida and sell some Property Insurance, NOT!!!!!! Kemper Insurance-PULLOUT, SAFECO Insurance-Pullout last year, American National Property & Casualty- Pullout and that isn\’t even all of them. Quit crying because of your lazyness of not explaining the policy, and *****ing because you feel the gov\’t owes you!!!!

    Go figure, always looking for the gov\’t to pay, or fix anything, since you didn\’t read your POLICY BECAUSE YOU ***-U-MED!!

    It\’s kind of scary when you start to think that the way to fix the coverage questions is to get the client to sign off on rejecting a coverage. Where does it end? FLood, earthquake, umbrella, ATV, boat, business, inland marine…The list could go on forever. IF you do your job right, and explain what is and is not covered at the time of the application, and explain it the SAME way to EVERYONE, then you shouldn\’t have a problem. I am a little leery of having the insd sign a rejection of coverage other than what is state mandated.

    Having the insured sign an acknowledgement / rejection form is your only protection from an E&O claim. Because it has been scientifically proven that there is a direct correlation to the sudden onset of memory loss by the insured and their filing of a loss notice.

    And while you\’re at it, FEMA/NFIP has had these really neat red stickers for years that state, \”This policy does not cover FLOOD Loss.\” Get some (they\’re free) and place one on the signature page of every property application / policy you sell.

    I am so sorry Kim and Amer Woman, You all have figured it out. State Farm has successfully duped Millions and millions of people and they have done this for over 4 decades. How could we have been so Stupid.

    You all have figured out what Millions of us have missed. Wow, something of a spectical. Everything is covered, no matter what the policy form says. Thank you for your keen insight. We all can just relax now.

    Does anyone have some \”Cool Aid\” for these girls. I think they are ready. Truly enlightened.
