The U.S. Labor Department’s Occupational Safety and Health Administration (OSHA) has cited Greg Clark Roofing and Construction and proposed penalties totaling $106,400 following the investigation of a fatal accident at a Montgomery job site.
“This company did nothing to protect workers from fall hazards, although they were aware of OSHA’s requirements and knew how to eliminate employee exposure,” said Ken Atha, OSHA’s Mobile area director.
OSHA’s investigation reportedly determined that on Nov. 10, 2004, a company employee had been removing debris from a roof, placing it into a wheelbarrow and then dumping it over the side of an unguarded roof edge. During the course of this work, the employee stepped through an unguarded skylight opening and fell 23 feet to a concrete floor.
OSHA issued two willful citations, with proposed penalties totaling $98,000, for failing to properly guard roof edges and openings and two serious citations, with proposed penalties totaling $8,400, for failing to initiate and maintain an effective safety program and provide employees with fall protection training.
The company has 15 working days to contest the OSHA citations and proposed penalties before the independent Occupational Safety and Health Review Commission.
