I have worked for a local company for almost two years as a truck driver. Eleven months ago I was injured on the job, a back injury which may result in permenant disability. After the accident I was informed by the company that I had worked for for four years that I didn’t really work for them, I was leased to them by a company by the name of Omne Staff Leasing out of New Jersey. Omne Staff Leasing has never paid a dime to me or for any medical treatment and has now been indited by the FBI for insurance fraud among other things and all their assets have been conficated. I was hired by the local company, drove their trucks, delivered their product and punched their time card but my pay check did have Omne Staffing on it. I was told by the company I actually worked for that Omne was used by them for pay role purposes only, until after I was injured. I’m bringing legal action against the local company as well as Omne. Wish me luck
I had a similar experience in working for an Electrical Company that insisted I was there employee in all employment related matters until I recieved a herniated disk and a torn sacroiliac that discovered accidently while doing denervations(nerve blocks) and it turned out the doctor dcouldn’t inject the spot he wanted to and I have morre pain. The first two years and nime months of my injury where pretty hard with an incomplete diagnosis, beause the amount of pain I was in was not acknowledge and even though I survived the first 15 months without any narcotic pian medications, after finally getting and appropriate medication for my pain, throug wrong lab work, I was accused of not taking my pain medication and was cut off, until I saw anew neurosurgeon and figured out why I had a false negative drug screen, if the doctor doesn’t order the right test, it is difficult to get the right conclusion. This I believe has more to do with doctor being recruited into the war on drugs/medications and in Florida work comp, I have no legal recourse for mistreatment or that while doctors were over looking my problems after two years, five doctors, two physical therapy places and two MRI’s, for an incomplete diagnosis, they all got paid while I got worse and in Florida after two years, income compensation stops.
I’m not disabled enough for SSDI and I’m not well enough to work or go to school, I’m still waiting to get fixed, sucks being me because of Florida Statutes that protect everyone else but the injured.
The payroll company that I was actually working for, this is what they do, they manage employees and are experts at avoiding liabilities through manipulation of the Florida laws. If they do something wrong in how they treat me, it is just a slap on the wrist.
It doesn’t seem to be improving and seems to have no intention of improving for Florida workers, only for employers, insurance companies, doctors and attorney’s. In Florida it has switched from the intention of why workers compensation laws were created, to the injured worker doesn’t really matter, but all the other parties involved do and the state is protecting the wrong people.
Welcome to work comp, hurry up and wait!
An American tale, by H W Coe Jr.
Born in 1965, up to this point, I have survived,
With talent squandered as lessons learned
I shout with pain, but am not heard
I remember times when I had no cares
With hope and family always there
A promised dream I live to see
As my country takes my liberties.
Born in time of war and strife
As others protect to save my life
From threats that I cannot perceive
As well, get them before they get me.
In the name of protecting Liberties
In Civics class they taught the dream
Why so many died for Liberty
All for me is what they said
Though I see no way to get ahead
I hear our leaders talk of peace
In battle cries of disbelief
Though I’m protected behind this wall
As big moneymakers take it all
To ignore the dream as time persists
And settle for a smaller list
Of dreams that I have tried to live
Along with others who do not give
As life goes on and friends betray
I saved my dreams for further days
To start a new to find some hope
Until my body could not cope.
Though my battle cry’s to save the dream
I wasn’t injured over seas
I fight to keep my head a float
While liberty’s dream steals my hope
As others read between the lines
And fill the blanks with their designs
My cry does fall on deaf dumb ears
Alone I live to shed my tears
Not to live as though a beggar
I just need health care to make me better
For years I worked to support the dream
As I was told I should believe
For near three years I have tried for help
Though not believed I’ve tried to see
Why they won’t take care of me
Liberty has bested me
The tangled web I could not see
As others hang with my same fate
I see them die, while they lay in weight
Though no one knows the pain they lived
As health care’s justice does not give

As health care’s justice does not give
I see the rules get worse with time
While work comp just ignores their crimes
Though not against the status quo
Of stately rules of bitter hope
The laws have changed to now offend
As cripples try to take a stand
With politics to cloud the daze
Of protecting life or so they say
They left me hanging in manipulation
What I learned in school is not this Nation
