    It’s a shame how people get taken advantage of. Situations like this make roofing contractors, like myself, look untrustworthy. With so many homes affected by the recent storms here in Texas, you would think there was enough business for everyone, so I can not comprehend why people, like this, would stoop to low measures just to get business. What a shame.

    I’m an adjuster and we see this ALL the time. It’s truly amazing how people hate insurance companies but are so quick to either try to rip them off or blame them when things go wrong. News flash people…contractors and attorneys both use that sentiment to try to rip you and the insurance company off. Do you like how much you pay for insurance? Probably not. Situations like this are a big reason insurance costs what it does. While I do feel for Mr. Guerra, it is likely he got himself into that situation because he didn’t see anything wrong with trying to squeeze more money out of the insurance company…

    To say that anyone who seeks more money from their insurance company is trying to squeeze money out of them is completely one sided and extremely biased. If you look at some of the findings coming out of the courts you would realize that there is a concerted effort by some insurance companies to under pay claims. A recent determination by the courts in Oklahoma found that State Farm and Haag engineering conspired with each other on how to undervalue claims. Hagg even did seminars for the State Farm field adjusters teaching them how to deny hail damage. In another case against Allstate, the plaintiff’s attorney managed to get in discovery, a copy of a consulting report from the McKenzie Group a report instructing Allstate how to underpay claims and in a profit loss analysis showed them how they would profit overall even when having to pay out on some of the law suits that may come. The actual slides used by Allstate in available in a book entitled, From Good Hands to Boxing Gloves. You must get the version that has the actual McKenzie Slides used in the report. This report has been adapted by many other insurance companies. It shows itself in the delay, deny and defend practices currently used by many insurance companies. I agree that there are some how illegally try to profit on insurance claims but to make claims against victims without any knowledge of the actual facts is blatantly wrong. Each instance is unique.

    I would have to agree with Peter on this. Am Fam has put into place a practice of breaking out the materials from the replacement line item therefore relinquishing about 30-40% of your profit. It’s hard for me to understand how you are required to provide a warranty for workmanship at this rate much less stay in business. I just wonder how much if any thought goes into these decisions that are made. Pisses me off to the point that I would like to sue to recover what is rightfully owed to me and my salesmen. I have all the experience I need.

    A loss is a loss, sent it to the courts and let them decide.
