Obviously homeowners insurance customers don’t want to be taken advantage of, so it is proper to go through the court system to take any grievance there might be. However there are two things to think about. One is that insurance agents/producers/csr’s try explain to the customer what a an actual cash value does and does not do. I’m not saying that they don’t but if there is a consistent explanation for new home insurance customers then that could help reduce future litigation from their end. Next is for the state lawmakers to pass a bill that makes the losing party pay for the attorneys’ fees. I thought that Texas already had that stipulation in lawsuits against businesses that the loser pays for attorneys fees.
We don’t have “loser pays” anywhere in this country, the trial lawyers keep fighting it and they have plenty of money to throw at politicians for their “lobbying” (i.e. bribery) efforts.
