The #1 problem with Louisiana is that you have outrageous judgments being handed down by the judges who hear most of the personal injury cases. The judiciary is extremely biased to the plaintiff lawyers in most parishes because they (trial lawyers) are the ones paying to get these judges elected. You can fix all of this craziness by simply lowering the jury threshold in this state. Right now its $50,000 and no other state is even close to that. If plaintiffs know they have to present their case to a jury and not a plaintiff biased judge, all of a sudden you see much more reasonable settlements and judgments. Need proof of this? Cross the border into Texas and your vehicle insurance premium will be cut in half. All personal injury cases of any value over there are decided by juries so you don’t have the rampant lawsuit abuse you have here. Its ridicuolous how a plaintiff can be hit from behind going 5 miles per hour and yet still get over $20,000 for a bogus injury with 6 months of so called “treatment” with a quack chiropractor. But that happens all the time in Louisiana with our “plantiff paid for” judges. You’d never see that in Texas because juries in any county would award nothing for such a bogus claim. But our wimpy legislature never wants to raise the ury threshhold and thus, rates will always be the highest in the nation here and stay low in other states.
