Wrongful Death Suit Filed Against Oklahoma Police

The family of a man fatally shot by the Pawnee, Okla., assistant police chief has filed a wrongful death lawsuit on the two-year anniversary of the shooting.

The estate of 25-year-old James Dylan Gonzales filed the suit Tuesday. The suit seeks more than $75,000 in damages and claims that the Pawnee Police Department used excessive force.

Police say Gonzales was a burglary suspect who led Assistant Chief Calvin Brown on a foot chase, then barricaded himself inside an abandoned nursing home. Police say Gonzales stabbed Brown in the face, and Brown then shot him.

Police Chief Herb Adson tells the Stillwater News-Press that Brown has recovered from the stabbing and remains assistant chief.
