Arkansas Residents Lose Suit Against Union Pacific

A group of Beebe residents who sued Union Pacific over claims the railroad was responsible for flooding in their subdivision have lost their case.

The Daily Citizen reports that a federal jury in Little Rock ruled Monday that flood damage at the 19 homes wasn’t the railroad’s responsibility.

The residents claimed that floods in December 2009 and May 2011 came about because the railroad was negligent regarding water flow surrounding its railroad tracks near the subdivision.

Union Pacific argued that residents knew they were building in a flood plan.

Homeowners had sought $75,000 each.
