    OK,remember this name, COLONY INSURANCE, they deny claims, even those that are covered under their policies and based on this article, they will litigate anything. Your premiums pay their defense costs against you while they raise your bill and the hail is pounding your roof. Where else but America.

    You missed the point, Fish Man – the jury clearly found that the plaintiffs lied – this had to be the basis of awarding the costs back to the insurer. That generally does not happen. You should not be rewarded for concocting a fraudulent scheme. This protected monies to be paid for legitimate claims.

    Hail is a serious problem in both TX and OK. We have public adjusters soliciting hail claims from insureds. It is VERY important that companies who write here defend when there is a question as to the date of damage. The more hail claims paid, the more deductibles and rates go up for everyone in the area.

    Colony should have discovered the hail damage (and initiated a claim on their client’s behalf) during the FIRST YEAR after the incident. If they are renewing policies without performing annual property inspections then this is irresponsible business practice in my opinion.
