The judge actually targeted the manufacturer? Whoa, what’s that gonna do for future suits?

Finally, justice that targets the right defendant! Instead of banging on the insurance company for [correctly] denying a claim, they went after the actual culprit.
Pick your exclusion, this is either a construction defect or pollution. This is almost a chicken-or-the-egg scenario.

China is determined to poison this country with their defective products, lead paint on toys etc. This country needs to get back to manufacturing our own products. So what if the Chinese drywall was cheaper. It is causing all kinds of trouble for builders, installers etc. If a product is made in China, someone should be looking at it with a jaundiced eye.

I have to agree with legal eagle, I do not think this judgement will ever be paid.

I hope the IJ will continue to keep an eye on this and let us know if the Chinese company does pay.

The judge can give any verdict he wants to…it’s an impotent judgment. No collection will occur. My curiousity is up though…there are more than 1300 plaintiffs. How is it that 1 law firm has received judgments on 2 separate lawsuits?

The factory is owned by a German firm. There is actually hope of recovery here.

At what point does China join the family of nations who are accountable to the public? If we are going to do business with them, they shoud be involved and responsible!

The issue with massive subrogation this Chinese company will be required to obtain online RFP bids from general licensed contractors to verify the true costs to repair property. If no open bidding then the litigation costs will just be so expensive that all of the injured parties will see 40% to 50% of funds going to the lawyers. To see an RFP online auction go to http://www.marinebidexchange.com which has been used to determine the costs to repair yachts and commercial vessels with results in just a few weeks. The RFP process will reduce the costs by 40% to 60% since no inflated costs and all contractors bidding and not have any marketing costs or legal fees in hiring repair experts to be paid to write reports and testify in court as to costs that would take years. The RFP Shows photos of damaged property in a open RFP and with full transparency. The government agencies can help in seeking recovery of funds since the Chinese could see the itemized bids online to renovate property by all contractors once the online auction closes. Each contractor can also post a mini web site showing all of the facts about their company so all can evaluate each company that bid and thus find not just the lowest bidders but the best candidate for the job. The process of open bidding would establish an over all data base on the costs all over the country and not just massive paper presentations having to be audited. The marine insurance industry has used this process now for 10 years and won the A.M. Best E Fusion Award in 2004. This website also could sell the damage property in an open forward auction like refrigerators, stoves, dish washers, air condition units, wiring, breakers, etc and help recover some funds. One persons junk is another person treasure who could use or rebuild and use damaged property that may be just damaged cosmetically. The issue is this is not a massive litigation wind fall for lawyers it is major issue of Americans in need of indemnification for those people with total honesty to resolve this problem.
