    this lady has a list of health problems a mile long but her family is very confident the loss of power is the true cause of her death. how jealous i am to not be blessed with such insight. give me a flipping break. on the bright side, i’m sure they’re not after money…they’re after justice.

    I’m sure you’re right that the family only wants money. I’ve defended many nursing home alleged neglect cases where the family had abandoned the patient, never once coming to visit, and then came out of the woodwork to collect after death from disease or natural causes.

    unfortunately, a driving factor in the settlement (which I hope was very small) was the expense to defend the case if it went to trial. it’s cheaper to pay some now than risk a crazy jury give a huge award.

    here here wudchuck! you’re usually pretty insightful and i think right on the mark here too. for an event to be so catastrophic, as was katrina, it’s not even remotely reasonable to expect all entities to be prepared for ANY type of disaster. to hold companies responsible, regardless of the severity of the event, is extremely dangerous and will become difficult to price adequately for.

    ok, here’s the other problem, how can anyone or anybody have predicted the amount of damage that was going to happen? i think like the previous posts, they just want money. if you look at the max exodus, we as a state and federal level could not get it straight. so the next thing you might say, is that folks will sue because of that due to katrina.

    due to the major catastrophe of katrina, i don’t think we are truly prepared either civil, state or federal level for a huge disaster. it’s going to take a combination of help from everyone and stop blaming anyone for a failure somewhere. there is no way we can have it all figured out. good example, is look at haiti. granted they never had been prepared, but look at the many countries scrambling to help them. so, now retreat back to katrina, there was no way that any one entity could have been prepared to solve any major problems. it took many organizations to come together and look, it still needs rebuilding.
