    @ Joe, funny.

    Why is this law so hard to pass? (Good for the states that have). People can barely talk on the cell and drive.

    Why don’t the insurance companies deny claims caused by driving and texting? Racing is excluded, I can’t see how this same exclusion can’t apply here.

    Why not exclude coverage when someone causes an accident because they were drunk? Why not exclude coverage because someone was speeding (not racing, just speeding)? Well, let’s say someone hits you because they were texting and driving. The company denys the claim because they were texting. How is that fair to you, the person that got hit because of someone else’s negligence, have their claim denied. That really defeats the whole purpose of liabilty insurance in the first place. Now, excluding all other coverages except liability, that I could get behind, but that would be hard to enforce in no-fault states such as Flordia.
