Forgive me but I am about full! If I read correctly “Todd said it was an aptitude test with pass-or-fail results that “significantly impacted minorities.” ” HOW IS THAT DISCRIMINATION?? Seems to me a test to see if you were qualified was in order and SOME DIDNT PASS. Not because of anything other than THEY DIDNT PASS A TEST. Last I knew woman and all minority groups attended the same educational institutions. If you dont pass the test you dont go to the next level (at least that is how it USED to be) So now if we are illiterate we can still get preferred employment because we are a minority!? Give me a break.
It’s OK to have a test that has adverse impact on protected classes IF the test has been shown to be valid (i.e., that the test actually predicts job performance). I haven’t seen the details yet, but it looks like Gerber lost because they didn’t have sufficient evidence that the test was valid.
My wife interviewed at a company that is hiring 60 people for an assembly position. She took the work keys test to evaluate if you are a good fit and she scored medium to high. The job would train you for 5 weeks. Even though she has 20 years of manufacturing experience with kaizen,just in time, QAS, QP, one piece flow, etc. She received a letter in the mail that said she was not hired. Now my wife is a White American, over 50, and very talented. The person that interviewed her said she had an excellent background and scored better than most. It has nothing to do with it I’m sure, but this women was a Black American. We are investigating now, sent letters to the HR managers (who did call back and asked questions), and we are currently entertaining a lawyer to see if she was discriminated against. Note the Equal Employment Opportunity Act of 1972 and the civil rights Act of 1964.
