Colon cancer is a slow moving disease that is easily diagnosed and treated IF caught early. You don’t just wake up one day with stage 4 colon cancer without some very noticable signs. Bottom line is this guy will get liftime benefits. Could/should he have had medical tests before now?
I think the language of the firefighter’s contract presumed any cancer was job related regardless of whether or not it was job related.
I think this was a just ruling, on the flip side the cities should screen fire & police for genetic predispositions for all cancers, diabetes & arthritis.
We shouldn’t be hiring people with genetic predispositions for diseases that may be exacerbated by their fire or police jobs.
Of course that would be illegal and discriminatory under current law.
so, if it can be related to this job, can we claim that any cancer we have is related to any job we have. and if so, does that mean i can sue for cancer as a workmans comp claim? if it’s good for one job, why not another? because how can you declare that any cancer is caused due to a particular job? um..um… sounds like a major lawsuit — class action and lots of money lost by the states! um..um.. can we also contribute that to lung cancer — uh oh! afterall, do we not have problems w/so-called 2nd hand cancer?! if folks walk into the building w/that smokey smell, can we get cancer from that? the cigarette smokes gets into folks clothes…. um..um… i see lawyers lining up for $$$$….
