I understand why these businesses would be upset, 10 days is a long time to go without business. But what would the basis be for their lawsuit? I doubt the blowout was malicious…is this something that could stand up in court?
Having done a little oil patch liability work in my salad years, it looks like the drilling company is a lead pipe cinch to be found liable – along with several of their service providers.
In the meanwhile, why don’t these businesses just make business interuption claims on their own policies….oooops, forgot – Louisiana – nobody carries any first party coverage except the bare minimum, if that
