    Sam – you can disagree with me all you like and the comment the judges are liberalizing the CGL policy just shows us your agenda. Sorry but an an insurance broker, I am looking out for my clients and providing them with the best coverage available, if you don’t do that well I feel sorry for your clients. What you fail to understand is that warranty issues/items are wholly different actual and true CD cases. This ruling effectively states that CD cases are not only real but they do result in Property Damage(s) and that it had to occur somehow and sometime and thus it fits within the definition of an occurrence

    Sam,
    What you are predicting is already the case in most states, as standard carriers have non-renewed much of their residential contractor books and seen it replaced in the surplus lines market with policies that have half the coverage at twice the price.
    Add construction defect exclusions to the long list of other hazards once found compensable, to be excluded from coverage for asbestos, lead paint, sinkholes, etc.
