Okla. Gov. Vetoes Tort Reform Bill

    The only folks who like \”tort reform\” are the Enron\’s of the world, insurance companies and big business. That\’s because the so-called reforms take away the rights of the little guys to take on the big guys. It\’s understandable, but, also, very unfair because the little guy doesn\’t have the resources to fight back.

    WHAT WOULD YOU EXPECT FROM THE LAWYER GOVERNOR AND FROM THE AG OF OKLAHOMA WHO GETS HIS CAMPAIGN FUNDS FROM THE TRIAL LAWYERS. DID THEY HAVE THEIR HEADS IN THE SAND ALL THE TIME THIS BILL WAS BEING DISCUSSED. NO OF COURSE NOT. THEY KNEW WHAT THEY WERE GOING TO DO ALL THE TIME. THIS IS JUST POLITICS IN THE STATE OF OKLAHOMA.

    Thank goodness the governor thinks about the people who are injured. Do the legislators think that it would be fair to them or their families if they were injured by negligent conduct and were then limited on what they could recover because of some artificial limit created by the legislature? As one of the minority legislators said last week, this bill was soft on negligence.

    TORT DEFORM IS MERELY A MEANS FOR INSURANCE COMPANIES, BIG BUSINESS, AND THOSE WHO HARM OTHERS TO TO PAD THEIR POCKETS WITH MONEY THAT SHOULD BE SPENT COMPENSATING THE PEOPLE WHO THEY HARM. JURY VERDICTS ARE DOWN SUBSTANTIALLY AND IT IS MORE COMMON FOR A JURY TO UNDER COMPENSATE SOMEONE THAN TO OVERCOMPENSATE AN INJURED PARTY.

    Thank God for Governor Henry. His veto of this very bad bill means that everyday Oklahomans will still have access to equal and full justice in the couthouses of our state. The only beneficiaries of this bill would have been the insurance industry, big oil companies, and big manufacturers.
    Doctors have been deceived by the soft cooing of the state chamber and its lackeys that civil justice damage caps will protect the doctors. Overwhelming and unbiased evidence supports the conclusion that damage caps only limit the payouts by insurance companies to catastrophically injured people and DO NOT lower doctor\’s medical malpractice premiums.

    This was a righteous veto.
