Insurer Trade Group Praises Passage of Okla. Tort Reform Bill

    Well, if you call heaven having to remedies or rights to those who are injured then yes, heaven for the insurance companies. The insurance companies have realized huge profits the past two years under the previous version of tort deform in our state but did they pass it along to the doctors– of course not!

    Would heaven allow a drunk driver to kill someone and not be held liable at all for their actions? Under SB 507, it allows for someone who has purchased life insurance to be penalized and if their life insurance is greater than the coverage the drunk driver has– guess what, the drunk killer pays nothing, how is that heaven?

    Or, you put somone in a nursing home, they kill your loved one– you want to find out how it happened, after investigating, you find they have had several people die to negligence of the nursing home to properly administer medicine or prevent falls– guess what, those reports that cited the home for deficiency are not admissible per this bill.

    Oh yeah, finally, would heaven discriminate against the elderly, poor, or stay at home mothers, SB 507 does. It caps damages for these classes of citizens who do not have income. So, a child is left paralyzed, they can only get so much according to this bill, we let juries put people to death, why shouldnt we trust them to determine how much a child under these conditions should be given for their injury.

    Something not often disclosed, an award that goes above the cap the legislature has included in SB 507, studes have shown that around 70% of awards that fall above that range involve paralysis, blindness, or brain damage. So this bill will impact the very classes of citizens and most aggregiously injured — for what purpose, to make the insurance company more money, which they will not pass on savings, they have had years to do it and havent, why would they change now.

    I believe under these conditions, it might be heaven for insurance companies who will continue to make record profits but hell for consumers, patients, elderly, poor, and children.

    Trial bar controlling the state senate?? When was that? We have more lawyers in our senate than prior to the last election. The author of the house version is a trial lawyer who represents insurance companies so of course his clients will directly benefit but of course wont pass along those savings. As for Senator Paddack, her husband is Vice-chair of the board of the largest insurer of doctors in the state– these elected officials dont care about the citizens, only the corporate profits they can pass along to their clients and family members.

    If the governor vetos the bill, it wont be due to his practice of law, rather his understanding of the violations of the state constitution that this bill encompasses.

    If the senators and house members who sponsored this bill really wanted to pass meaningful legislation, they would pass things they knew to meet constitutional muster that would make the system more effecient and reduce frivolous claims without taking away the rights of those who have meritorious claims– that is the kind of reform I believe the governor would sign and rightfully so.

    The trial bar no longer controls ouyr state senate. Thus, the passage of the bill. However, our Governor, a trial lawyer by trade, has yet to sign it. He has promised tort reform in his campaign speeches. We\’ll wait to see if he realy means it!

    If SB 507 passes, you can now call Oklahoma heaven. Every state needs this version adopted to their own state.
