How the hell is the University responsible for this?? He is a grown man who made his own decisions. I\’m sure that if this was some normal everyday Joe, she would no longer be tr4eating or suffering any pain. But, the deep pockets involved here fuel her \”disability\”.

Gee, Reagan! You took the words right out of my mouth! Are they sure that this didn\’t occur in California? Aaah! Deep pockets at it\’s best!!! You know, the University is supposed to monitor his EVERY move. Next thing you know, they will equip all of their employees (volunteers, etc…) tracking systems in their shoes and portable breathalizers that will register his BAC electronically
via the cell phone. Oh…and someone will have to accompany them every time they use the rest room….good way to spread the narovirus (rotavirus, rhinovirus, etc…) My goodness – why not make Sutton responsible for his own actions? I am so sick of people not taking responsibility for their own actions – how am I supposed to teach my kids responsibility when the world around them urges them that it\’s always \”someone else\’s fault\”….sorry, everyone! Had to vent!

Sounds like the coach was going to to catch a team plane in an OSU vehicle, ergo acting within the course and scope of his employment a the time of the accident. Could be he had a pattern of drinking and driving that was known to his employer and they did nothing to stop him from driving under the influence. Clearly, Coach Sutton is responsible, but his employer may very well be liable as well.

I also wholehartedly agree with your sentiments. I try to teach my kids the right thing to do/be responsible without regard to who else is pointing a finger or shouting it\’s someone else\’s fault. Hard to grit your teeth, but it\’s gotta be done. Good luck, but I\’m pretty sure you don\’t need it.

Based on the information provided in this article, WJK is correct….Sutton was acting in the course of his duties as an OSU employee.

Certainly coach Sutton is responsible but so is the University, for the actions of their employee.

Rick, you and WJK may be right, however, I have some doubts regarding the complaint. The suit ALLEGES that OSU was negligent for \”allowing\” Sutton drive an OSU vehicle with a BAC three times the \”legal\” limit (legal limit? what an oxymoron that is!!!) If I were on the jury, I would have to have SOLID proof of that fact. I may be a bit biased due to the fact a good friend of mine was killed by a drunk driver when she was just 20 years old and the driver refused to take any responsibility. This is the issue I have a problem with….No one wants to take responsibility for THEIR OWN actions.
If we keep thinking like the two of you, what kind of message does this send to our kids?
