La. Commissioner Orders Insurers to Extend Hurricane Prescription Period

    Prescription periods, or statutes of limitations, are set by the legislature and are a matter of statutory law. An administrative agency can\’t act in excess of its statutory grant of authority. If the legislature didn\’t act, how can the commissioner? Also, now a year has gone by, this isn\’t exactly an \”emergency\”. How exactly is this going to work?

    It,s ging to work in favor of the attorneys because now they can rack up the fees for all the hurricane lawsuits they are going to file. Now they have and extra year to find customers.
