Just another case of the American Citizen refusing to take responsibliity for his/her own actions. Nobody held a gun to our (smokers) heads and made us smoke. If we make bad or dangerous decisions then we should be the only ones responsible for the outcome. If we allow this trend of out of control litigation to continue then we will make it impossible for businesses to survive out of fear of being sued. Wake up America and lets stop blaming everyone else for our own stupid mistakes. You make your bed, then lie in it. I’ve been a smoker for 20 years and if I die from it it’s my own fault.
I couldn’t agree more. The dangers of smoking are well documented, and had been for years before I lit my first one. An adult making an informed decision is and should be solely responsible for their actions.
This ruling is also ridiculous in the penalty it provided. In a capitalist society, is there anything more patently absurd than asking a company to pay for people NOT to buy their product? Imagine that…sounds like a winning lottery ticket…I can hear the conversations now…
“OK, MR. Manufacturer. Give everyone $20, so they’ll never want to buy your toaster”. Give me a break.
This is another example of legislation by verdict, a practice develeloped by civil trial lawyers to fatten their own purses. The last tobacco settlement was billed as the single largest transfer of wealth ever, and they were not talking about the payments to the states. They were talking about the payments to the attorneys.
I agree with the rest of the comments. I had smoked for over 40 years. I only quit because of the flu. Took a month to smoke 5 cigarettes, so gave it up. It was my decision to start smoking, even with all the warnings. I really enjoyed it. I even swithed brands from time to time. The cigarette manufacturers never put a gun to my head to start. If every person who smoked got cancer, then we could say it was the cigarettes fault, but that is not the case. I am really tired of all the class action suits. The ONLY PEOPLE who ever see any money is the attorneys. What a greedy bunch they are. I hope that soon, the courts will say enough is enough, so more lawsuits against the cigarette companies and no more class action suits against anything.
