Irony…Insurance Claims Journal writes “Gargan said he would have had to shut down his company if he filed a claim with his professional liability claim”. Had it occurred that if Gargan had the sense to file a claim, that the downward spiral would not have happened? Why would a $100,00 claim that have collapsed the company, when the limits of coverage would have been multiples of that?
I agree with the second part of your comment in how could a PL claim bring down his company. He didn’t make a claim knowing his intentional acts would not be covered but uncovered in the investigation.
