Very good advice. Speaking from the standpoint of a mediator of insurance claims, I can tell you that there is always positive progress to be made when parties are informed and willing to allow the mediator to ethically work the room to draw closer understandings of the law and facts.
As California mediator, I rarely see well-prepared lawyers in mediation. Most of the time, I see lawyers shooting from the hip and shooting themselves in the foot. Hopefully, people will read this blog and take Michael Packer’s excellent advice seriously.
