Debra should have called the police and had the guy who broke her wrist arrested for assault. She should have sued him for her damages and if he had no liability insurance, had his wages garnished a lien put on his property. Why look to the state to clean up the mess caused by some loser. This isn’t like uninsured motorist coverage.

I partially agree with Alan, but I will add something. My daughter is in this situation right now, she was asaulted and her nose was broken. Why should she have to pay attorneys fees and sue for her medical bills in civil court? Why should I pay higher insurance premiums for defense, and or claims payments, involving these A holes! These people should be forced by the State in criminal court to pay repairations to victims; ALL VICTIMS! (including my medical insurance company that paid part of our claim.)They should be incarcerated until those debts are paid in full! On leave from that incarceration only on work release. 100% of what they make should go to their debt.

The state has no legal status to prosecute a claim for your damages.

I will keep that in mind when next time I take a baseball bat to the guys head. And politicians wonder why average law abiding citizens take the law into their own hands. We are indeed a weak country when it comes to crime and punishment.
