All attorneys should have a warning label tatooed on their foreheads: Warning – Do not expect attorneys to use common sense or consider your best interest
While these “warning labels” have some comedic value, they’re also a sad reminder of how plaintiff attorneys have forced businesses to anticipate their stupid antics and creative theories of liability. The primary focus is now 100% defense against being sued. Sad commentary. Of course our wonderful and incredibly outdated legal system allows frivolous suits to continue hence the need to play this cat and mouse game with attorneys. Proximate cause remains the standard, at least in theory…. “that action but for which the loss would not have occured.” Stupidity and carlessness ususally account for most proximate causes.
I have a ball point received from a law firm of my acquaintance which states clearly on the barrel: “Caution – this pen contains ink – do not write something which you will later regret”
