Merck Settles Vioxx Lawsuits for $4.85 Billion Without Admitting Fault

    Merck was winning these claims that they were attacking one bye one; however the cost to litigate outweighed the cost to settle. The only ones that win are the attorneys, who are getting a ridiculous some vs the individual claimants. Aren’t their risks with all drugs?

    This makes me want to puke. Merck caving in was a travesty. We have people who can’t afford prescription drugs now. Who do you think is going to absork the cost of this “settlement”? $1.6 billion in attorney fees for the plaintiff lawyers is unconscionable. They should be reimbursed for their hours spent on each case and nothing more. People in this country just don’t get it. Here’a respected drug maker who takes it in the backside for trying offer a pain killing drug. It would serve people right if drug makers refuse to offer any prescription drugs to the public until they have been studied for 10 years. Penalizing a firm for something that is unforseen is absurd.

    What has always bothered me about this whole affair is how it was handled.

    1) The FDA approved this drug, and as many side effects as were known were listed on the informational sheet provided with the medication. So the increased risk of heart attack/stroke was noted.

    2) The doctors that prescribed the drugs should have discussed the risks with the users as well as their family members and decided if the risk was acceptable.

    3) The pharmacists dispensing this medication should have explained the usage, side effect warning signs, and risks of using this medication with their clients.

    So after all these steps, people are suprised that they too are subject to possible side effects, that they are mortal?

    Also there are people out there that would still use Vioxx even with the risks, just to be pain free. I disagree with the fact that Merck was forced to pull the entire product, restrictions would have been sufficent.

    This settlement saddened me greatly. Merck should have kept fighting the good fight and quashed all the money grubbers out there.
