    “Craftily ambiguous” What do you expect, lawyers wrote the policy. Plain language attempts cost carriers thousands of dollars to establish “what it really means” in the hands of a lawyer.

    These people should be suing their agents for not telling them they needed flood insurance.

    Those idiots knew they did not have flood coverage on their HO policy. My retarded 6 nephew even knows that. Sorry but the only people these people should be suing are themselves for being ignorant.

    I agree, their agent should have told them… and probably did. Unfortunately most agents don’t have tape recorders in their offices with archival records of every discussion they’ve had with clients and most do not make customers sign an afidavit saying they understand what has been offered but rejected, discussed, etc.

    On the other hand…

    If I bought a house below sea level, on the coast of one of the most hurricane prone bodies of water, surrounded by aging technology being used to hold back the water I wouldn’t need someone to tell me I needed flood insurance.

    Then again, if I bought that house I’d need my head examined anyway.

    The judges in NJ seem to have taken some sanity pills, they might be able to help out here.

    Heck, when I started looking for my house my real estate agent told me if I bought something too close to the river I would need flood insurance. Then my insurance agent told me. Then my mortgage broker told me. Then my mother told me. Then my real estate and insurance agents reminded me.

    And the place is (was) below sea level! If you can’t figure out you need flood insurance from that I don’t know how to help you.

    If the Agent did offer flood
    and the Homeowner refused it….
    The Agent must produce a signed waiver
    or else the Agent is liable….

    No if, ands or buts….
