    It is simply a dreadful situation. But, having been exposed to it first hand, it just boils my blood everytime it comes up. It is there. There is no denying it. The Employment Laws were compiled from the voluminous data generated by these claims. Companies hire managers with sordid attitudes toward subordinate employess who do not resemble them in likeness, appearance, or lifestyles. Other employees are kept from testifying unless they themselves are directly and adversely affected by the defendant’s treatment of the plaintiff. It is simply a hellish experience to continue working under the circumstances one must endure in these cases. Then there are those who will no doubt join the defendant’s side and see the plaintiff as a whiner, complainer, and malingerer. Win or lose, hopefully these types of cases help level-the-ship and treat everyone as an important person that is essential to the success of the companies that contibute to the American economy. Greater emphasis should be placed when hiring people up-and-down the employment ladder who display the morals, values, and attitudes that lead to greater understanding among the races in the American Workplance. The Law is the only remedy to modify this ugly side of human nature. We are human beings and not animals in the jungle where the rule of the day is to eat or be eaten.

    Billy, I have experienced what this person has experience in the work place, More so now because of President Bush allowing laws that protect against Racism to be amended to favor Corporate America. The “White Male Republican” and now Female too, Corporate America is aware that these laws have weaken and are taken advantage of these weaken laws by laying off more “Minorities” ever in American history without any explanation. I have worked for the number two insurance broker in the Country and fourth and fifth largest Japanese insurance companies out of Japan and the number one German insurance company in Germany here in California. I have worked for and with major and small insurance agencies throughtout my 34 years in this business as an underwriter. This Insurance Industry is generally controlled by the “White Male Republican.” Hence, Racial and Gender Bias Descrimination runs rampant in this industry. First, I must say that the Germans were great employers and never ever discriminated against anyone here in America and they prove it over and over again that they are here in America to conduct business for profit and that is all and for that I personally give them an A+ for excellent humanitarian behavior.

    I have personally experience racial descrimination in the form of name calling such as “Wetback” by my VP/Manager in front of other laughing white male and female employees. If it wasn’t for the consoling email sent to me by one of the white male employees that was present during the name calling no one would have known about it. I still have that email, it help me prove my point of contention. Oh, by the way my boss was never disciplined for his actions instead he was transferred to the New York office and promoted to Sr status and a year later was brought back to California after I left. This matter was handled by an all white mail HR and a good friend of my boss. Harassement and humiliation are other factors involved as in one case where the white male and females planned a Christmas Party at a restaurant located in a famous Universal Studios amusement park. The waitress was given a list of names of our group for seating and dinner purposes and when they called out my name they called me a “Pigs” name and I told them that was not my name and all three waitresses indicated that the named were email to them as written and they were sorry. I noticed that white girls and boss were laughing, then I realize what had happen.

    That fact is racism will remain for as long as we allow it to remain.

    By the way, these companies now hire people with spanish surnames to cover up their bad behavior. I talked to some of these people with spanish surnames and tell that they don’t speak spanish.

    I hope and wish to God that this person prevails to swing the arms of justice his way because I’m a baby boomer and getting tired of racial discrimination.

    One final story, if an insurance agency does not want to work with a “Minority” that agency will find a way to get him/her fired by complaining about rush work sent to him,(Minority) and complain to the carrier that the applications are not getting done on time.

    While I empathize with anyone being discriminated against for any basis, it is not fair to paint the entire United States Insurance industry with the same broad brush, stating that all companies discriminate. I work for a company that tolerates no type of discrimination. I’m sorry for your bad experiences Johnny, but don’t paint the entire industry in a bad light because of it. It just is not true.

    Johnny, I’ve rotated as a Mgmnt Trainee through all facets of a a National Ins Co. I’ve worked, also, in Calif. Calif is the worst State with respect to administrative jobs for Hispanics. I lived and had friends that underwent the same racial discrim, i.e., City of Glendale, Lockheed, Movie studios, etc. There are however many good “Anglo” folks. They hate had the fact that they cannot put an end to the way their cohorts behave toward people who do not bear Anglo surname, because they have to feed their families. I was once told that we could not interpret insurance contacts and had no business in insurance. Our specialty would always be in the Food industry or along Ceasar Chavez in the grapefields. President Bush who can barely speak English, knows what it is to work with Mexicans in West Texas. But, look, he’s placed two Hispanics as Cabinet Members. Clinton only helped one. The Law in the only forum for change. Delibrate Speed does not mean for the Law to delierate its speed. We are citizens. Look at the number of Hispanic Medal of Honor winners who have shown their bravery on behalf of the Honorable Basis of the USA. Yet, even in the military service I’ve seen hatred and comtempt for Hispanics. I was an E2 and faced daily harassment by told by 2 Anglo enlisted E6’s that my mother and sisters worked the streets of Tijuana as prostitutes. I complained to the E7 and E8’s about it, and all they did was call me a “whiner”. The Lawyers are the only ones who can change this ugliness!
