Class Action Filed Against Manufacturer Over Tainted Pet Food

    The American legal system being what it is with respect to not placing much value upon animal (pet) life (in general, they are considered as chattel), those posters who opine that the lawyers are in it for themselves have a valid point.

    This company does deserve to be punished, however, for the heartache that it has caused and the lives that it has taken. That said, a sane resolution to the dispute would be the creation of a trust of several million dollars to be distributed among voluntary pet rescue organizations nationwide. In that fashion, the deserving get their due, and the profiteers do not.

    Ok, so most of you know me, are probably expecting me to say boo fricking hoo, get over it. But not so. I too have a dog that is like family too me and my boys. She has had two TPLO surgeries at a cost of 3grand a piece and last Sept came down with Pancreatitis and spent two weeks in intensive care at a cost of 12 grand. Luckily she pulled through and is doing great now. I feel for these people who lost their pets, but class action is not the way to go. The only winners will be the attorneys. After 3-4 years of litigation, all the claimants will probably get a coupon for $2 off their next pet food purchase. I say fine if pet owners want to go after Menu foods on a one on one basis, but please don\’t de-file the memories of these pets by letting snakes take the share.

    Totally agree with you Compman – Class Action only means millions of dollars to line the pockts of the attorney who jumped into the ring first – Firm believer of tort reform in this country – these leaches should be strung from the highest tree and left out to dry – They know perfectly well what the outcome will be and are praying on the emotionally distressed and generally uninformed public who think they are going to be compensated for their loss. Whether for a pet or another member of their family – the only winner is the snake that conned them into the nest.

    I have no problem with a class action lawsuit if it leaves Menu bankrupt and without the ability to obtain insurance for their future claims (which will no doubt happen because this company\’s big concern is cutting corners to put bigger profits in the CEO\’s pockets.) Hence, shipping wheat products over from (lack of quality control) China rather than purchasing ingredients made here on this continent. Most of the companies affected by the recall don\’t care about your pets either; their big concern is making the most amount of money they can rather than offering a quality product.

    I have to agree that the only people who win in class action suits are the attorneys. The US has the most expensive tort system and our litigious society is at the root of what is sending US companies to other countries to buy product and to set up shop in other countries. Until there is tort reform on a national basis it will only continue to get worse. Many states are already passing legislation capping damages, modifying the joint and several liability rule, limiting punitive damages, etc. There are two reports out that highlight the current state of our Union when it comes to litigation. The first is entitled \”Tort Excess 2005: The Necessity for Reform from a Policy, Legal and Risk Management Perspective\” (available at http://www.iii.org) and \”Jackpot Justice, The True Cost of America\’s Tort System\” (Just released and available at http://www.pacificresearch.org). It\’s time to start lobbying for tort reform on both a local and national level.

    Lisa,

    Menu foods is actually majority owned by a mutual fund. Guess who invests in mutual funds? yea, people like us. So if the goal is to bankrupt the company, by doing that you are taking a lot of regular people\’s retirement money and giving that to the trial lawyers. Sure, the kneejerk reaction is to punish, but who are you actually punishing?

    yeah, lowest unemployment rate in decades, highest per capita income on record. Stock markets at record highs, Home ownership at record highs, highest GNP in 50 years, God, I am so glad Bush got elected and put our economy in the toilet!!

    Stock market at record highs? Not this month, last month or last year…

    Unemployment at lowest level \”ever\”? not exactly. GNP? Lets talk foreign trade deficit, energy costs, health care oh, and that little conflict know as IRAQ.

    GWB is an embarrassment and his administration is a disaster.
