At Congressional Silicosis Hearing, Doctors Refuse to Testify on Diagnoses

    I guess I\’ll be the first reader to say that these lawyers, doctors and litigants should be prosecuted for fraud and civilly sued by the insurance carriers who were ripped off for medical claims and in liability settlements and defense costs. Recoveries should be used to reduce rates for all insureds. How about the damage caused to numerous small businesses like a tombstone monument company I couldn\’t place because the carriers were afraid of silicosis exposure! Gimme a break!

    This practice was fictionalized in Grisham\’s novel \”King of Torts\”.

    Grisham also recounted this practice in \”The Summons\”. I guess he was trying to warn us.

    Suspend the medical licenses of the Doctors in question, and send a memo to all of the defense lawyers who face a claim supported by these doctors\’ testimony. Then sanction the law firm which encouraged the whole charade.

    I am usually an optimist. Maybe, just maybe, this is the start of the turn of this issue to a more reasoned stance.

    My optimism is tempered by the fact that the vast majority of politicians are lawyers and they know that they will be killing the cash cow if they do anything of merit on this issue.

    What really needs to happen is for the U.S. Attorney to seek criminal fraud indictments against the claimants that had the \”double diagnosis\” of both silicosis and asbestosis, and made claims as a result. Then, accept \”no contest\” pleas to lesser charges in exchange for their cooperation in filing civil (where the burden of proof is less) RICO actions against the doctors and lawyers involved, seeking treble damages and bankrupting the jerks.

    Come to think of it, maybe this is a job for NY \”Super-AG\” Elliot Spitzer, as it closely resembles his strategy aginst Hank Greenburg. Except, of course, that as a Democratic candidate for governor, Spitzer can\’t very well sue his power base.
