Lawsuit Alleges Hewlett-Packard Misclassified Employees

    Microsoft paid dearly for this years ago. Some lessons are hard learned. At the same time, these are adults with college degrees. When is it time for them to take some responsibility??? Fact is, they knew the deal. Now because they saw an attorney it is somehow unfair? How many of these so called victims were turning downs other potential W2 JOBS to come work for HP? How many of these claimed home office deductions and opened SEP accounts? How many of them are just trying to squeeze out a few bucks for their retirement because they have done a poor job of saving on their own? Or so that they can get a new set of wheels? How many contractors agree with the claimants?

    Lastly, understand just how thin the line is here. These laws were generated before computers came on board. They were generated before telecommuting. Fact is, they are out of date in this economy. The primary distinction with an IC vs. employee is the ability to control them. Problem is the notion of control is dead in this economy. How many employers think they are really in control of any employee?? What happens when you push the control button too hard? Doesn’t Tom Peters remind us it is all about Brand You? Finally, I have a hard time believing that folks who earn 60K and upward are really victims in today’s society. This is truly a waste of resources and a reminder that no good deed goes left unpunished! Perhaps HP’s response will be to send the jobs offshore. How would that feel?

    This guy has no idea what he is talking about. They are “contracted workers” contracted by HP employed by manpower, adecco, etc, not “contractors”. they are W2 workers, work at HP, have HP desks, HP email addresses, HP decides when , where and how they will work. They are managed by HP managers – have fake adecco/manpower managers who do not manage just relay orders from the HP managers. In all things are HP employees except paid 1/2 the salary and worked 2x the work. they are HP employees in every sense of the word, just that HP is trying to “bend” the laws to their benefit at the expense of the “Managed Service” employee.
