    As a Insurance and Reinsurance Litigation Consultant retained by Law Firms through out the US, with 40 years of insurance experience, I can agree that the work load of litigation has increased. Reinsurers don’t want to pay Insurers and Insurers don’t want to pay their Clients.
    Most resort to Litigation.

    Following Mr. Barile’s comment…. I would suspect that the reasons for a high percentage litigation against insurance companies is the twisting of contract language and terms (ie: what is an “occurrence” [WTC case]; what treatment is “medically necessary”; what is a desease.. alcoholism, obesity, etc… And, the portrayal of insurance companies as the big bad monster. Just ask the trial lawyers out there.

    Well, it sounds like the study finds that the litigation is mainly businesses sueing other businesses, not the “nuisance” lawsuits filed by consumers and their trial lawyers. This indicates that the current proposals for tort reform are not getting at the real problem and will limit the ability of consumers to sue while letting the big guys go at it.
