Once again we see how the modern insurance industry, which claims to be borne of free markets, is really based on a statist philosophy of government. In a truly free market, we would have no regulation and the courts would decide the rights of insureds vs. insurers.
According to this supposedly “free-market” model, though, courts should have no role at all in the governance of the insurance industry and everything should be under the control of regulators and legislators – who are easily manipulated by Big Money.
The courts are the last truly independent arm of government which exists. Their role should not be reduced; it should be increased.
