Seriously? Sometimes good people make bad decisions and this is the case here. 18 year old hot-rodding it, jumped the tracks and serious consequences ensued. It is not the railroads fault. Why not sue the auto maker as well for making a vehicle that went 69 MPH? This should be thrown out, but I know it won’t because “someone has to pay”……

Sorry about the loss of the children but I would bet that the speed limit was less than 68 MPH. I’d toss this out in a millisecond.
