Ohio Court Reviews Rules for Pothole Damage Claims

With winter here the Ohio court that handles claims for vehicle damage caused by potholes is highlighting procedures for filing those claims.

The Court of Claims processes hundreds of filings a year from Ohioans seeking compensation from the Ohio Department of Transportation.

The court says drivers must first determine if the road where the accident handled is overseen by the state or a city or township.

pothole Next, drivers must prove ODOT knew about the pothole and that the agency’s failure to fix it quickly led to the damage.

The court says drivers can present affidavits from other drivers in the area and a log of calls complaining about potholes maintained by ODOT.

About half of drivers filing claims receive compensation.
