Woman Hit in Eye by Sword Gets 2nd Chance in Indiana Court

May 24, 2013

A woman who was struck in the eye with a sword while watching a fencing match at Notre Dame will get another chance in court.

The Indiana Court of Appeals ruled Wednesday that a Marion County judge should have given Lydia Lanni more time to gather evidence before granting judgment to the NCAA.

Lanni sued the NCAA after her eye was seriously injured by a sabre at a 2010 fencing match that she said was sanctioned by the NCAA. The NCAA said it hadn’t sanctioned the match.

The court says the local judge should have given Lanni more time to rebut the NCAA, but he acted correctly when he rejected Lanni’s motion to exclude an affidavit by the NCAA’s fencing championships manager, who testified the match wasn’t sanctioned.
