the first lawsuit is stupid; the second by the robber’s mother is even more so. since when is a robber entitled to “reasonable care for his safety”? what is the world coming too?
There is no liability as there was no duty owed and no duty breached. She’d have been a lot more traumatized if this loser has cut her throat. Her suit should be dismissed. As for the mother of perp…..anything for a quick buck. She should get a directed verdict and award of $1.00 so she can’t file an appeal.
But our government will not even consider tort reform in this country. Institute the “loser pays” rule and this garbage goes away. Parasite attorneys are taking these beyond-frivolous cases in the hopes of shaking down some deep pockets. Theory of liability: res ispa retainer.
