Lawsuit Settled Over Deadly ATV Crash in Nebraska

A lawsuit filed by a woman injured in a deadly ATV crash in Saunders County, Neb., has been settled.

Autumn Kadavy and three others were riding on an ATV driven by Myles Virgil in August 2009 when he hit a guard post and lost control.

Passenger Brenda Strizek, died, and the others were injured.

Virgil pleaded no contest to motor vehicular homicide and was sentenced to 120 days in jail and five years of probation.

Kadavy sued. The Lincoln Journal Star says the parties in June agreed to $500,000 settlement to be paid by Virgil’s insurer and the company that covered the ATV.

The newspaper says Kadavy’s attorney says the judgment has been paid.

A second lawsuit filed by Strizek’s estate is pending.
