Trucking Company Seeks New Venue for Nebraska Lawsuit

A trucking company and one of its drivers being sued by the son of a Lincoln, Neb., man killed in a 2010 crash are seeking to have the lawsuit moved to federal court.

Bradley Cusatis Jr. sued Canadian company Leo Trucking Inc. and one of its truck drivers for the death of 44-year-old Bradley Cusatis Sr., who was a passenger in a car hit by a semitrailer on Dec. 18, 2010. Investigators say the truck driver lost control of his rig on a patch of ice-cover Interstate 80, causing the crash.

Cusatis’ son sued for wrongful death in Lancaster County District Court. The company and driver say that because they are based in Canada and the lawsuit seeks more than $75,000 in damages, a move to U.S. District Court is appropriate.
