    Somewhere there’s a personal injury attorney smacking his lips, ready to file a wrongful death suit. Most hotels have warnings clearly posted “NO LIFEGUARD ON DUTY – SWIM AT YOUR OWN RISK”. This be a no liability claim.

      You’re probably right, but there’s no way to tell based on the facts presented. Maybe this hotel had a lifeguard on duty who decided to take a break and didn’t wait for his replacement. Maybe the pool had depths stenciled on the sides of the pool, but they were not marked accurately. Who knows at this point. Again, you are probably correct, this is no liability, but you have to wait for all the facts before you make a judgment. Too many adjusters jump to conclusions leading their company to bad faith denials.
