An appeals court is considering how much money is owed to the parents of a Jefferson City, Mo., woman who died after falling from a climbing wall.
A rusty safety cable broke in July 2003 while 22-year-old Christine Ewing was scaling the wall outside a minor league baseball game in Columbia. She fell 20 feet to the asphalt.
The Columbia Tribune reported that a three-judge panel from the Missouri Court of Appeals Western District heard arguments this past week about the size of the insurance payment.
Ewing’s parents, Craig Ewing and Kathleen Schmitz, settled a wrongful death case with the wall’s owner, Marcus Floyd, for $700,000.
However, they believed the baseball team, the Mid-Missouri Mavericks, was still legally liable.
At issue is the amount they are owed. The court expects to rule in 30 to 90 days.
