    What a moron – I guess Underhill is one of the 30,000,000 americans without their own health care coverage – or the sense enough to get out of the way when a dog the size of a golden retriever is seen “bounding” her way – Probably hates animals too…

    Her knee was probably injured before and is just finding an excuse to bleed someone else for the cost… I assume there is no “pre-existing” injury clause in the statute either…

    that is what i thought, because it does not say that the lady was knocked over by the dog and she landed on an object. sounds to me like it might have re-aggrevated an old injury, much like those sports folks or military folks who sometimes goes bump into a table. so, let’s put this in context: if i happen to be in her house and accidentlly bump my knee and i need further surgery to repair my knee, i am going to sue! yet, i have been in her house for years. now i am hurt because i bumped my knee on her table. i am suing her for injury! now, let’s put this a different way, this dog obviously knew this person, because it was a playful animal. afterall, she was visiting this friend. so, now i have to assume my dog friendly greeting is now being held liable? I DON’T THINK SO!! you’ve been around my dog for sometime. it was not chasing you.

    now you wonder why our courts are logged jammed with frivilous lawsuits. so this case has been to several courts already and now is headed to the state supreme court. next thing you know, if they don’t succeed here, they will push it to US Supreme Court.

    I could see how the forcefulness of a dog coming at you might hurt you. Was she playful with the dog, calling the dog ect.. Thats not in the article. She knew the person and dog so, she should have known how the dog greets people. I dont think playful dogs mean to hurt people and I think people can get hurt like this everyday. I think this is a lawsuit that should not be happening. I warn people all the time about my dogs and their playfulness by saying you dont want hair all over you do you? Disabled people have guide dogs and guide dogs usually do not go off their work schedule unless they know a person is safe and are called and allowed. I think their is someone getting a free knee out of this.

    Granted we don’t know all the facts from this article. It’s pretty safe to say the dog was probably not harnessed at the time this took place. Normally, well trained service dogs aren’t going to jump on someome. I’m guessing this was probably more than just the first thing the dog did in play.
