    IT WILL FLOOD. That is what Flood insurance is for. Don’t like the risk then don’t live next to them! Avoidance is what you need to do!!!!

    America is just getting sue happy and everything is someone else’s fault…….

    Don’t like snow move out of Montana. Don’t like heat don’t live in TX!!!!

    1st of all I agree with the known risk of exposure scenario. What the suit is about is that the Lake Belton area failed to comply with the paperwork necessary to partake of the flood program which meant flood insurance was not available to purchase even if they had wanted it. I think I’d sue as well.

    So the recovery ranges from $250,000 to $450,000 and they want more. Sure would like to see the justifcation for fair market value in this economy.

    S is correct. At the time of the flood Lake Delton was a “Non-Participating Community” in the NFIP so flood insurance through the NFIP was not available to these homeowners. They probably could have had flood insurance protection through a surplus carrier if they had wanted to pay the premium. Remember, we all have flood insurance, it just depends on how you want to pay (once a year or every month for many years).

    You must not be familiar with the area because these homes were easily worth what they are seeking. These homes were luxurious. Several were second summer homes for wealthy Chicagoans. Really the amount they are seeking is certainly fair even in the depressed market. Whether there is merit to their lawsuit, I will leave that to the courts. The community was a non-participant to save taxes and encourage development. I don’t empathesize with someone who moves in knowing that they live on a lake and insurance is not available. It’s not like the residents didn’t know that before buying the lots – or at least would have known if they would have asked – and I certainly asked when I bought my house because flood insurance can be a big expense. This isn’t a scenario where they lived there and their ability to buy the insurance was taken away. If they cared that much, were is the village board meeting asking that they reconsider the program?
