problem is that he’s expecting that his daughter is going to have a health problem. but you are not going to really know in the future for sure about anything. this is only a speculation. so how much are they going to get resolved? how badly is the feds doing their job? or for that matter what about the state? i would be suing the state for non-clean air. but here’s the question: how much is actually attributable to the local vs the various industry located just on the otherside of the lake? if he’s so interested in his daughter’s health, what about his own? or the rest of his family? if it is so bad, why has nobody else done this?

The fact of the matter is that this is a Federal and State regulatory issue. They tell the manufacturers how much toxin they are allowed to release into the atmosphere. The liability is with the government here not with the company’s who are doing what they are allowed to do by law. There have been no damages to recover. There is no tangible effect that can be measured in this suit. All they can get is a “Please stop it” type order and no monitary gain is possible. First rule of tort law – who has the deepest pockets – go after them. Second rule – prove damages please.
If it is that bad and this guy is retired he simply needs to move to a local where it is not as bad. The government and company do not mandate where he is allowed to live.
