    better call the Wahhbulance!. Must be a 1st year law student taking this case. Their is all types of notices, waivers, etc from the airlines about how they can change their plans at any time as long as they notify you. Sounds like this guy doesn’t read very well. And this guy flys “fairly often”, but is now just realizing the higher mileage points needed? And if he was such a frequent flyer, he probably wouldn’t care about the extra mileage charge as he would have lots of extra miles to spare.

    The lawyer should know all about “unjust enrichment”! You can bet he’d never have filed suit if he couldn’t make it a class action, and if the court won’t certify it as a class action, he’ll drop it like a hot potato. Class actions are a lawyers’ game. About 50% of any award goes to these lowlifes, and the rest is split among the tens of thousands or more of plaintiffs. Unfortunately, most class actions are settled because of the high admin costs, even though they have no merit at all. Class action is just another word for Protection Racket, or legalized extortion.

    In my opinion the threat of class action status serves as a consumer protection. Unfortunately I agree with the Claimsman 100% — the lions share goes to the attorneys and the actual injured parties get nothing.

    All too often we read stories about a law firm getting $50,000,000, and the actual victims getting coupons or vouchers with short expiration dates worth a few hundred dollars.

    I have no problem with class action status as a concept but I have a problem with the reality — more should be done to make sure the attorneys do not unjustly gain from the proceedings at the expense of the injured persons.

    It is the same concept as giving to a non profit who uses a collection consulting firm that charges 80 cents for ever dollar raised. The intent is great, the execution reeks of greed.

    I know that’s more than spellcheck can handle for you but COME ON! Didn’t you graduate 5th grade yet?
